Child Support

A child in Alabama has a basic right to receive support from its parents. In divorce cases and custody disputes, family law attorneys and courts are tasked with ensuring that the needs of the children in the case are provided for. After the appropriate amount of support is determined, the payment is made by the non-custodial to the custodial parent, usually on a monthly basis. Because child support payments are usually processed through the State, the calculation, collection, and enforcement of child support is a rather technical subset of family law that can be difficult to navigate.

Calculating Child Support in Alabama

Child support is calculated using a standard mathematical formula, taking into account the incomes of each parent, the costs of childcare, the monthly health insurance premiums for the children, and any pre-existing child support or alimony being paid by either party. In special circumstances, the court may deviate from the amount calculated under the child support guidelines, but this only occurs in exceptional cases and usually requires proof of a valid reason.
