Contested Divorce

Like marriage, no two divorce cases are alike. Some matters are simple and inexpensive, while others are complex and costly. If you and your spouse are able to successfully negotiate all of the issues in your case, then you can normally accomplish an uncontested divorce without ever stepping foot in a courtroom. In general, such cases can be negotiated, prepared, filed, and processed within 45-60 days.

However, if an agreement on all issues is not possible, then a contested divorce case must be filed and proceed through the family law system, a process which involves the filing of a complaint, the filing of an answer and counterclaim, the discovery process (the gathering of documentation and evidence), and the trial (the presentation of testimony and evidence in court).

Both contested and uncontested divorce cases are tedious and legally technical. Drafting and filing a marital settlement agreement requires attention to detail and specialized knowledge to get it done correctly the first time. Similarly, preparing evidence in a contested case necessitates the particular knowledge and experience as to what documents and testimony are more likely to have evidentiary value in the courtroom.

At Davis Family Law, we strategize every case from the very beginning until the very end.  We draft thorough and meticulous agreements that are legally sound and cover all the potential issues in your divorce.  And, if your case ends up in court, you will have peace of mind knowing that your legal team has prepared hundreds of cases for trial in Mobile, Alabama.
